Infiniteria files new lawsuit against Enviro over pyrolysis licence rights

Swedish recycling firm Infiniteria has escalated its legal battle with Scandinavian Enviro Systems by launching fresh proceedings in Sweden, seeking a court declaration that its exclusive licence to Enviro’s patented waste tire pyrolysis technology remains valid. In a statement issued on 20 June, Enviro confirmed it had been notified that Infiniteria Europe intends to file a declaratory action before the Swedish Patent and Market Court, arguing that its exclusive licence is protected as a right in rem and that Enviro’s termination of the licence agreement on 20 March 2026 should have no legal effect. Infiniteria is also pursuing compensation for legal costs and interest. Enviro, however, insists the termination was carried out in accordance with Swedish law as part of its ongoing company reorganisation. The company claims the exclusivity of the licence lapses upon termination, effective 20 June, and that it is now free to utilise its patented pyrolysis technology across Europe. Enviro has vowed to vigorously defend its right to deploy and develop the technology, including potential counterclaims for damages and costs. The dispute traces back to earlier this year when Enviro moved to terminate agreements tied to their joint venture in end-of-life tire pyrolysis as part of a restructuring effort. In May, the Gothenburg District Court rejected Infiniteria’s attempt to halt the reorganisation, ruling that Enviro’s restructuring process should continue. At that time, Enviro described the agreements as financially burdensome and detrimental to its sustainability, while Infiniteria filed a preliminary damages claim of €84 million.
